Invitation for Negotiated Procurement Two Failed Biddings TITLE: PURCHASE OF VARIOUS FOOD ITEMS FOR SUPPLEMENTAL FEEDING PROGRAM 2026 (16TH CYCLE) OF LGU MALANGAS Purchase Request No. 26-08-484 ABC ₱2,162,500.00 1. In view of two (2) failed biddings, the Local Government Unit of Malangas, through its Bids and Awards Committee (BAC), invites interested, legally, technically and financially capable suppliers to participate in Negotiated Procurement under Section 35(a) of Republic Act No. 12009 and Section 35.1 of its Implementing Rules and Regulations (IRR), in relation to Section 64. 2. The LGU Malangas, through the Trust Fund FY 2026, intends to apply Two Million One Hundred Sixty-Two Thousand Five Hundred Pesos (₱2,162,500.00) as the Approved Budget for the Contract (ABC). Procurement is on a ONE-LOT BASIS. Suppliers must quote for every item; an offer omitting an item or exceeding the ABC shall be rejected. 3. Delivery shall be completed within Thirty (30) calendar days from the effectivity of the Notice to Proceed, subject to inspection and acceptance by the End-User and compliance with the final Schedule of Requirements and Technical Specifications. 5. Posting and negotiation schedule This invitation shall be posted for at least three (3) calendar days on PhilGEPS, on the LGU website if available, and at the designated conspicuous place within the LGU premises, pursuant to Section 50.3.2(b) of the IRR. The BAC shall invite at least three (3) suppliers, including suppliers disqualified in the previous biddings. Suppliers responding to the required postings shall also be allowed to participate. Negotiations may proceed even if only one (1) supplier responds, subject to Section 35.1.1(b) of the IRR. 7. Negotiation documents shall contain the BAC-approved eligibility requirements, technical specifications, delivery schedule, financial offer forms and terms of the contract following the mandatory review. If no revision of the Section 52 eligibility documents is found necessary, submission of the PhilGEPS Certificate of Registration (Platinum Membership) is mandatory. The documentary checklist and submission stages shall comply with GPPB Circular No. 06-2026. 8. All participating suppliers shall receive the same requirements and clarifications and equal opportunity to negotiate. After negotiations, the BAC shall communicate the final technical and financial requirements and request best offers on the specified date. Sealed best offers, including all required documents, must be received by the BAC Secretariat by the deadline. Late offers shall not be accepted. Authorized representatives shall present a valid identification card and appropriate written authority from the supplier. 9. Evaluation and verification shall follow the final requirements and award criterion stated in the negotiation documents. The BAC shall recommend award to the Head of the Procuring Entity pursuant to Sections 35.1.1(e) and 66 of the IRR. The LGU reserves its rights under Section 70 of RA No. 12009 and its IRR. 10.
